All of Mónica Penaguião's work is under her company Poeira Design and the related services are made available to her in accordance with the following terms and conditions and any other rules published on our website. Please read the Terms and Conditions carefully before placing any order on the Poeira Design webshop. We recommend that you keep a copy of our Terms and Conditions for future reference.

We may modify the terms and conditions from time to time. Please read the terms and conditions and check back often. If you do not agree to any changes to the terms and conditions, you must immediately stop using the website. However, any changes made after placing an order will not affect that order unless we are required to make the change by law.

ELIGIBILITY FOR PURCHASE

Primarily, we want to draw your attention to our policies regarding terms of purchase within the Terms and Conditions and in our Privacy Policy. If you are under 16 years of age, you must inform your parents or guardians about the Poeira Design Privacy Policy before using this website or any of the services on this website. However, we reserve the right to only accept orders from over 18s.

When you want to buy a product, you must provide your personal data. In particular, Customers must provide their real name, telephone number, email address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details, and you represent and warrant that the payment details provided in the order are valid and correct and that you confirm that you are the person named in the billing information provided.

The site is only available to individuals and other persons who meet Poeira Design's terms of eligibility, who have received a valid credit card from a bank acceptable to Poeira Design , whose requests are acceptable to Poeira Design , and who have authorized Poeira Design to process a charge or charges to their credit card in the amount of the full purchase price of the merchandise they purchased. Poeira Design reserves the right to restrict various quantities of an item being shipped to any given customer or postal address.

By making an offer to purchase goods, you expressly authorize us to perform credit checks and, where Poeira Design deems it necessary to transmit or obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit card number or credit reports, to authenticate your identity, validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use the personal information provided by you to carry out appropriate anti-fraud checks. The personal information you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

REQUESTS

All orders are subject to acceptance and availability. Poeira Design offers products for sale that are in stock and available for shipment from our warehouse. Occasionally, however, we may be waiting for shipments from our suppliers. Please note that items in your shopping cart are non-reserved and may be purchased by other customers.

ACCEPTANCE OF YOUR ORDER

Once you have made your choice and your order has been placed, you will receive an email confirming your order details. This email is NOT an acceptance of your order, just a confirmation that we have received it. Unless you cancel your order, acceptance of your order and conclusion of the contract between you and Poeira Design will be completed when we send you an email to confirm that the goods have been dispatched. The sales contract is therefore concluded in Lisbon, Portugal.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not meet our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out in the T&C.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time in our sole discretion. We will not be liable to you or any third party for our removal of any merchandise from the site, whether or not that merchandise has been sold; remove, filter or edit any material or content on the website; refuse to process a transaction or undo or suspend any transaction after processing has begun.

FORM OF PAYMENT

Payment can be made by Ideal, Visa and MasterCard and any other methods that may be clearly advertised on the website from time to time. Payment will be debited and released from your account after your order has been shipped by Poeira Design . You confirm that the credit/debit card being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation and authorization checks by the card issuer. If your payment card issuer refuses to authorize payment, we will not be responsible for any delay or non-delivery.

We take all reasonable care to make our website secure.
All credit card transactions on this website are processed using a secure online payment gateway that encrypts your card details in a secure host environment. To help ensure that your shopping experience is safe and simple, Poeira Design uses Secure Socket Layer (SSL) technology.

Furthermore, we will take all reasonable care, to the extent within our power, to keep your order and payment details secure, but, in the absence of negligence on our part, we cannot be held responsible for any losses you may suffer if a third party gains unauthorized access to any data you provide when accessing or ordering from the Site.

PRICE POLICY

The prices shown on the website are in Euros and include VAT at the rate. Prices in British Pounds and US Dollars are also shown, however prices will be in Euros when purchased.

All prices and offers remain valid as announced from time to time. The price in Euros of a product displayed on the website at the time of order acceptance will be honored, except in cases of patent error. Product prices are set at the start of each season using existing exchange rates. These prices are subject to change if the applicable exchange rate changes before your order is accepted or if items are subject to discounts at any time during the sale period.

SAFE

Dust Design guarantees each purchase during the time it is in transit until it is delivered to the specified delivery address. We require a signature for all delivered products, when responsibility for purchased products passes to you. If you have specified a recipient other than yourself for delivery purposes (e.g. as a gift), then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by Poeira Design and transfer of liability likewise.

DELIVERY

When we receive your order, we strive to deliver your package as quickly as possible. If the item you ordered is in stock, it will be shipped from our warehouse within 24 hours (on working days). If you live in Portugal, we strive to deliver your package within 1-2 business days. If you live in the EU, we strive to deliver your package within 3-8 business days. Estimated delivery times are to be used as a guide only and start from the date of shipment, Poeira Design is not responsible for any delays caused by destination customs clearance processes or problems with after-sales companies. When you place an order on the website, we will email you the tracking number the day your package ships. You can check the status of your order using the tracking number.

IMPORT AND CUSTOMS DUTIES

Any customs or import duties are collected once the package arrives at the destination country. These charges must be paid by the recipient of the package (this also applies to retail and wholesale customers). Unfortunately, we have no control over these charges and cannot say what the cost will be, as customs policies and import fees vary greatly from country to country. It might be a good idea to contact your local customs office for current charges before ordering so you aren't surprised by charges you weren't expecting.

RETURNS AND EXCHANGES

If you want to return your purchase, you can do so within 7 days after delivery of the order to the delivery address. To process your return correctly, please make sure you fill in the information on the packing list you received with your order and send it back to the address on the packing list. Please send your package back with the same after-sales company you received it with. If you are not sure which post order to use, send an email to dust@poeiradesign.com and we will give that information.

We will refund what you paid for your order, but not the delivery or return fee. Each item comes with an attached return label. If the label seal, the label itself, or the way the label is attached is damaged or broken, the item cannot be returned and no refunds will be given.

EXCHANGE

If you wish to exchange your item for a different size, please return the item originally purchased and re-order the correct size. If you need help with dimensions, please contact us. If you wish to exchange your item for an alternative style, we suggest that you return it and purchase the new item separately.

REIMBURSEMENT

Your refund will be credited to the original purchaser's credit card or bank, excluding shipping costs where applicable (with the exception of defective items). If your order was shipped to a destination within the EU, all sales tax will be refunded. Outside the EU, customs duties and sales tax are non-refundable through Poeira Design .

Please note that card refunds may take up to 10 business days for your bank to complete, depending on the processing time. Variations may exist between card issuers and, unfortunately, we cannot influence this process.

IMPORTANT

All items are quality controlled and checked for flaws before being shipped to customers. If you receive an item that is not in perfect condition, please contact us immediately ( dust@poeiradesign.com ).

If you wish to return an item(s), you must do so within 7 days, with the return label still intact and the packing list completed. The return address and more information about returns can be found on the packing list you received with your package.
Ship all items you want to return from an order in the same shipment to ensure your return is processed as quickly as possible. Items must be returned in their original packaging to ensure they are adequately protected in transit.

OUR POLICY

Items must be returned unused and with all Poeira Design return labels still attached. Damaged or soiled returns may not be accepted and may be sent back to the customer at their own expense and/or a refund refused. Please send an email to dust@poeiradesign.com if any of your purchases were delivered without Poeira Design labels.

DEFECTIVE PRODUCTS

Please note that items damaged as a result of normal wear and tear are not considered defective. If you would like to exchange a defective item (instead of getting a refund), please note that we can only replace it with the same product of the same size, subject to availability. Where possible, we will offer repair for damaged items. If it cannot be repaired or the same product is not available, you are entitled to a full refund. If you receive a defective product, please inform us by sending an email to dust@poeiradesign.com .

COLORS

We have made every effort to display as accurately as possible the colors of our products that appear in the virtual store and on the Poeira Design website. However, because computer monitors vary, we cannot guarantee that your monitor's display of any color will be completely accurate.

CONTENT

In addition to the intellectual property rights mentioned below, "Content" is defined as any graphics, photographs, including all image, sound, music, video, audio or text rights on this website. Poeira Design tries to ensure that the information on this website is accurate and complete. Poeira Design does not guarantee that the content of Poeira Design is free of errors. We always recommend that all Internet users ensure they have up-to-date antivirus software installed. Poeira Design reserves the right to remove any content from this site at any time and without reason.

The property, software and content displayed on Poeira Design cannot be used for commercial purposes. Nor for any advertising activity on your own website. This website is for your personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer or sell any content, software, products or services contained on this site.
